HAYMAKERS MMA WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND MEDIA RELEASE AGREEMENT

PLEASE READ CAREFULLY - THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS

1. ASSUMPTION OF RISK

I fully understand and acknowledge that:

- Participation in martial arts, fitness training, self-defense instruction, weapons training, or any physical activity involves inherent risks, including but not limited to serious bodily injury, permanent disability, paralysis, illness, or death.

- Risks may arise from my own actions, the actions or negligence of others, equipment failure, environmental conditions, or the nature of the activity itself.

- I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of Haymakers MMA, its owners, instructors, staff, volunteers, or participants.

2. WAIVER, RELEASE, AND INDEMNIFICATION

I hereby release, waive, and forever discharge Haymakers MMA, its owners, agents, officers, employees, instructors, volunteers, affiliates, landlords, contractors, and any other individuals or entities acting on its behalf (collectively, the "Released Parties") from any and all claims, liabilities, demands, damages, losses, or causes of action (including negligence and strict liability) related to personal injury, property damage, wrongful death, or other damages that I may suffer arising out of or in connection with my participation.

I further agree to indemnify and hold harmless the Released Parties from any and all claims, lawsuits, damages, or costs (including attorney's fees) brought by third parties arising out of my conduct or participation.

3. MEDICAL AUTHORIZATION AND RELEASE

I certify that I am physically fit to participate in strenuous physical activity and that I have no medical condition which would prevent my safe participation. I agree to notify the staff of Haymakers MMA of any medical or physical conditions that may affect my participation.

In the event of an emergency, I authorize Haymakers MMA to seek medical treatment on my behalf, including transport to a medical facility, and I agree to be responsible for any associated costs.

4. MEDIA RELEASE AND CONSENT

I grant Haymakers MMA, its representatives, and affiliates the irrevocable right and permission to photograph, record, and/or film me during training, classes, events, or while on premises, and to use such images, video, or audio recordings for any lawful promotional, advertising, educational, or commercial purposes, in print, on the internet, or in any other media format, worldwide and in perpetuity.

I waive any right to inspect or approve the finished product, including written or spoken copy that may be created in connection therewith. I understand that I will not receive compensation for any use of such likenesses.

I release Haymakers MMA from any liability related to the use or distribution of such media, including claims of defamation, invasion of privacy, or violation of publicity rights.

5. RULES, CONDUCT, AND TERMINATION

I agree to abide by all rules, regulations, cultural expectations, and codes of conduct set forth by Haymakers MMA. I understand that failure to comply with these rules or exhibiting conduct deemed unsafe or inappropriate may result in immediate termination of membership or participation without refund.

6. BINDING AGREEMENT AND SEVERABILITY

This agreement shall be governed by the laws of the State of Tennessee. If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

This waiver is intended to be broad and inclusive as permitted by applicable law. I have read and understood this agreement in its entirety and enter into it voluntarily and without inducement.
